Refugee status or asylum may be granted to people who have been persecuted or fear they will be persecuted on account of race, religion, nationality, and/or membership in a particular social group or political opinion.

Asylum Procedure:

Any noncitizen who is physically present or has arrived in the United States may apply for asylum. An application for asylum must be filed within 1 year after the date of the noncitizen’s arrival in the United States, unless there are changed circumstances. An applicant for asylum must establish that he or she is a refugee. This means that it must be established that race, religion, nationality, membership in a particular social group, or political opinion is at least one central reason for persecution against the applicant.
